Terms & ConditionsSection I The Regulations stipulate service conditions, regulations regarding event organisation and the rights and obligations of the Organizer and the Ordering Party. Section II The Organiser provides public event organisation services based on a written contract. The reservation placed by the Ordering Party shall be treated as a proposition of the conclusion of the contract for event organisation. Reservations can be placed in writing, orally or by phone. After placing reservation, the Ordering Party shall receive event confirmation document including essential information on the reserved event and a copy of public event organisation contract in writing. Section III At the conclusion of the contract, the Ordering Party shall make an advance payment for the event. The advance payment shall amount to 20% of the event price. The rest of the due amount shall be paid at least on the day of the event. Section IV The type and scope of services, provided as part of the event, are stipulated in the offer of the Organiser. Before the contract is concluded, the Organiser is entitled to change the offer, of which the Ordering Party shall be notified immediately after placing the reservation. The prices of events and additional services listed in the offer, regulations and other documents submitted to the Ordering Party are expressed in PLN. Section V The Ordering Party is entitled to cancel the event before it commences. The Ordering Party is obliged to submit a cancellation statement in writing. The date of the cancellation statement is the date on which the statement has been received at the office where the contract was concluded. § 6 In case of cancellation due to the reasons referred to in Section 4, Sentence 2 (changing offer by the Organiser), the Ordering Party is entitled to the refund of the advance payment provided that a written cancelation is sent not later than 7 days before the day of the event. Section VI The Organiser is entitled to terminate the contract for event organisation within the period of 7 days before the event commences by notifying the Ordering Party in writing if: § 8 If the event cannot be performed due to the reasons arising from the actions of the Ordering Party, the Organiser is entitled to terminate the contract for event organisation by notifying the Ordering Party in writing. The Organiser is still eligible to demand payment of the price of the event. Section VII The Organiser shall perform the contract of public event organisation with due diligence and professional standards of the conduced business activity. § 10 The Organiser is not responsible for any damage caused by participants of the event and damage resulting from misfeasance, malfeasance or nonfeasance of third parties, which were marked appropriately in the offer. Section VIII Any claims arising from failure to conduct the event in accordance with the contract shall be notified to the Organiser within the period of 14 days after the contractual conclusion of the event. § 12 Any claims arising from this contract shall be terminated in accordance with the general regulations of the Polish Civil Code. Section IX The invalidity of individual provisions of the agreement shall not entail the invalidity of the tour agreement as a whole. It is also applicable to above-mentioned requirements. Any disputes arising from the performance of this contract shall be settled amicably, and where there is no resolution they shall be settled by the local court nearest to the registered office of the Organiser. |
